Terms of Service

These terms cover the website only. If you hire Digital Lotus Development, LLC, that engagement is governed by a separate written proposal or services agreement covering scope, deliverables, price, payment, timelines, revisions, intellectual property in the work product, and termination. Where the two documents disagree, the signed agreement controls.

Nothing on this site is an offer capable of acceptance. No client relationship is created by browsing the site, submitting the contact form, or booking a discovery call. Digital Lotus Development, LLC may accept or decline any project or inquiry, including supported-rate inquiries, at its sole discretion.

You may read, share, and link to this site freely. You may not:

• Use the site for any unlawful purpose, or in a way that infringes anyone's rights.
• Attempt to gain unauthorized access to the site, its server, or any connected system.
• Interfere with the site's operation, including by scraping at a volume that degrades service, or by probing, scanning, or load-testing it without written permission.
• Submit false information, or use the contact form to send spam, malware, or bulk unsolicited messages.
• Copy substantial portions of the site's text or design and present them as your own.

The text, project write-ups, and arrangement of this site are owned by Digital Lotus Development, LLC. “Digital Lotus Development” and the Digital Lotus mark are ours. The site's visual design is adapted from the Positivus template by Olga Averchenko, used under its own license and credited in the footer.

Third-party names, logos, and trademarks appearing on this site remain the property of their owners and are used for identification only. Nothing here grants you a license to use any of these marks.

You keep ownership of anything you send through the contact form or by email. You grant us permission to read, store, and act on it for the purpose of responding to you. Please do not send confidential material before we have a confidentiality agreement in place, and please do not send passwords or credentials at any point. How we handle what you send is described in our privacy policy.

We aim to keep the site up but do not guarantee it. The site may be unavailable for maintenance, provider outages, or reasons outside our control, and we may change or remove any part of it at any time without notice.

This site links to pages we do not operate, including our booking page, partner profiles, code repositories, and project demos. We do not endorse and are not responsible for their content, security, or practices. Following an external link is at your own risk.

The site and its content are provided “as is,” without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Our disclaimer explains what the content is and is not.

To the fullest extent permitted by law, Digital Lotus Development, LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of your use of this site. Our total liability arising from the site is limited to one hundred US dollars ($100). Liability arising from paid work is governed by the signed agreement for that work.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. Where that is the case, these limitations apply only to the extent permitted, and nothing here limits liability for fraud, or for death or personal injury caused by negligence.

These terms are governed by the laws of the State of Missouri, United States, without regard to its conflict-of-law rules. Any dispute arising from the site will be brought in the state or federal courts located there, and you consent to their jurisdiction. If you use the site from elsewhere, you are responsible for complying with your own local law.

If any provision of these terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. We may update these terms; the date at the top of this page shows when they last changed, and continued use of the site after a change means you accept the updated terms.
